1). George BLACKALL 30214 address Killard, Clare, Ireland !listed in Co. of Clare List of Freeholders for the year 1821 !10 OCT 1782 is the date of his marriage settlement in BLACKALL pedigree of Sir H W B BLACKALL 16 OCT 1782 is the date given in the BURNELL pedigree Irish Genealogist, IV, 2, p.77 . The settlement was registered 20 NOV 1782, Bk. 344, p.578, no. 234042. !Although a Protestant, he conformed 9 NOV 1776 as his mother was a Roman Catholic and it was held in Clarke v. Parsons Smith & ors. Exch. 23 NOV 1754 that a person born of one Popish parent was deemed to be a Papist unless he conformed. This case was reported in Gorges Howard s Cases on the laws against the growth of Popery , published 1775, and in the following year Protestant George enrolled as a convert a date a year earlier is given in Sir H W B BLACKALL s pedigree of the BLACKALLs . This Gilbertian conversion was doubtless effected as a safeguard against Protestant Discoverers , who might otherwise have deprived him of his property.
2). Marcella Margery BURNELL 30222 Sir H W B BLACKALL in different places describes her as child of Christopher BURNELL 4329 of Ranaghan, Co. Clare and Mary BUTLER 4330 or of Henry BURNELL and Mary D ARCY the former seems unlikely, given the dates or Mary BUTLER s 2 marriages in Burke sIrish Family Records. Situation may be clarified by consulting The Burnells and the Penal Laws in Ir. Geneal. vol. 4, no. 2, 1969 and also Blake Butler in Burke s L.G.I. 1958, which may differ from the 1976 version. Final sources are Butler and McNamara of Ayle in Burke, 1976. !Marcella s half brother son of Christopher , Henry BURNELL m. Barbara, dau. of Patrick FITZGIBBON, uncle of 1st Earl of Clare. !her sister Elizabeth 4331 married her brother in law Charles BLACKALL M.D. as early as 1772. This is inconsistent with their parents having married as late as JAN 1763.
